Savchenko’s lawyer says the prosecution’s case will fail

People’s Deputy of Ukraine Nadiya Savchenko, who was arrested earlier for two months, cannot be accused of cooperating with terrorist organizations because Ukraine did not recognize the separatists of the Luhansk and Donetsk People’s Republics (LPR and DPR) as terrorists, lawyer Rostyslav Kravets stated in an exclusive commentary for InfoResist.

Kravets explained that no legal regulation in Ukraine recognizes the DPR and LPR as terrorist organizations, which is why filing charges under terrorism articles will pose problems for the investigation and the court. At the same time he noted that a People’s Deputy can be accused of treason and preparing a coup d’état.

Kravets also believes that the court and the Prosecutor’s Office committed violations in collecting evidence in Savchenko’s case. However, the investigation may not reveal the data of the pre-trial investigation yet.

“In my opinion, the court and the Prosecutor’s Office committed certain violations. In principle, at this stage, the investigation has the right not to disclose the data of the pre-trial investigation in full. That is, only the court can see it. And it was discussed whether it was surveillance or not, or alleged covert surveillance, but I believe at this stage the defense has not been provided with this kind of information. It will be provided when materials of the pre-trial investigations are provided,” Kravets said.

If the defense successfully proves that investigative and operational activities were carried out without the authorization of a judge, the prosecution can fail, the lawyer added.
